Identify the fee calculation

Ask which amount the percentage applies to, whether the percentage can change at later stages, and how the agreement treats appeals or related matters. The written agreement controls.

Separate fees from case expenses

Ask which expenses may be incurred, who approves significant costs, when they are paid, and whether they are calculated before or after the lawyer fee.

Read termination and referral terms

Ask what happens if you or the firm ends the relationship and whether another lawyer or firm may receive part of a fee. These terms vary and should be explained in writing.

Request a sample accounting

Ask the firm to illustrate a hypothetical recovery statement showing the gross amount, lawyer fee, expenses, possible repayment claims, and net amount. The example is educational, not a prediction.

Keep the signed version

Retain the agreement and later amendments. Before any distribution, review the written accounting and ask about entries you do not understand.
